By placing an order through our online store, you agree to these Terms.
1. Scope
These Terms apply to all purchases made through the online store operated by bike-p-arts.
The online store primarily offers motorcycle accessories, styling products and aftermarket parts intended for the visual customization and personalization of motorcycles.
2. Products and Intended Use
Our products are primarily intended for aesthetic and customization purposes.
Unless expressly stated otherwise in the relevant product description, our products are not intended to modify the engine performance, emissions, noise characteristics or riding characteristics of a motorcycle.
Products must only be used for their intended purpose and installed in accordance with the applicable product information, installation instructions and safety information.
The customer is responsible for determining whether a particular product is suitable for the customer's motorcycle and intended use.
Where the installation or use of a product may affect roadworthiness, vehicle safety or legal compliance, the customer is responsible for ensuring that the product may lawfully be installed and used on the relevant motorcycle and in the relevant jurisdiction.
If there is any uncertainty regarding the suitability or installation of a product, professional advice should be obtained before installation.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions and other information displayed in the online store are accurate.
However, minor differences in colour, appearance, dimensions or finish may occur, particularly due to manufacturing processes, screen settings or production batches.
Where information regarding compatibility, installation or technical specifications is provided by a manufacturer or supplier, such information is reproduced based on the information available to us.
Customers should not rely solely on photographs when determining whether a product is suitable for a particular motorcycle.
4. Manufacturers and External Suppliers
The products offered through our online store are sourced from independent manufacturers and suppliers, including suppliers located outside Switzerland.
bike-p-arts does not manufacture the products itself.
Orders may be fulfilled and shipped directly from an external supplier or logistics partner to the customer.
The use of external suppliers or direct shipping does not alter the customer's contractual relationship with bike-p-arts where the purchase is made through our online store.
5. Orders and Formation of Contract
The display of products in our online store does not constitute a binding offer to enter into a sales contract.
By submitting an order, the customer makes a binding offer to purchase the selected products.
The customer will have the opportunity to review and correct the order before submitting it.
After the order has been submitted, the customer will receive an electronic confirmation of receipt.
A contract is concluded when we expressly accept the order or otherwise confirm that the order has been accepted and will be fulfilled.
We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where a product is unavailable, incorrectly described, or cannot lawfully be supplied.
6. Prices and Taxes
All prices displayed in the online store are stated in Swiss francs (CHF), unless otherwise indicated.
Unless bike-p-arts is registered for Swiss VAT, Swiss VAT will not be separately charged or displayed.
If applicable, customs duties, import taxes, fees or other charges imposed by the destination country may be payable by the customer, unless expressly stated otherwise during the ordering process.
7. Payment
Available payment methods are displayed during the checkout process.
Payment must be completed using one of the payment methods offered in the online store.
We reserve the right to use third-party payment service providers for payment processing.
8. Delivery
Products may be shipped directly from external suppliers or fulfilment partners, including suppliers located outside Switzerland.
Estimated delivery times are displayed on the relevant product page or during checkout where available.
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including customs procedures, shipping delays, supplier delays or other logistical disruptions.
If a delivery is substantially delayed, the customer may contact us to request information regarding the status of the order.
9. Customs and Import Charges
For shipments originating outside Switzerland, customs duties, import VAT, handling charges or other import-related fees may arise depending on the shipment and applicable law.
Unless expressly stated otherwise, such charges are not included in the product price and may be payable by the customer.
Customers are responsible for complying with the import requirements applicable in their country of residence.
10. Returns and Refunds
Any return or refund will be handled in accordance with applicable Swiss law and the conditions stated in our Return and Refund Policy.
Customers should contact us before returning a product.
Unless otherwise agreed, products should be returned in an appropriate condition and with the relevant order information.
Nothing in these Terms limits any mandatory rights that cannot legally be excluded or restricted.
11. Defective or Damaged Products
If a product arrives damaged, defective or materially different from the product ordered, the customer should contact us as soon as reasonably possible and provide relevant information, including photographs where appropriate.
We will assess the issue and, where applicable, provide an appropriate remedy in accordance with applicable law.
Customers should not install or use a product where there is a reasonable indication that the product may be defective or unsafe.
12. Product Safety
Customer safety is a priority.
Products must not be used if they are damaged, defective or otherwise appear unsafe.
If a customer becomes aware of a potential safety issue relating to a product purchased through our online store, the customer should stop using the product where appropriate and contact us immediately.
Where necessary, we may cooperate with manufacturers, suppliers and competent authorities concerning product safety, recalls or other corrective measures.
13. Motorcycle Compatibility and Road Use
The customer is responsible for checking compatibility before purchase and installation.
The fact that a product is marketed for a particular motorcycle model does not necessarily mean that its installation is approved for road use in every country.
Customers are responsible for complying with applicable laws and regulations concerning vehicle modifications, roadworthiness, registration, inspection, certification and permitted use.
Unless expressly stated otherwise, we do not guarantee that a particular aftermarket product is approved for road use in every jurisdiction.
14. Installation
Installation should be carried out in accordance with the applicable installation instructions.
Where a product requires specialist knowledge, tools or technical expertise, professional installation is recommended.
bike-p-arts is not responsible for damage caused by improper installation, incorrect use, modification of the product, failure to follow installation instructions or use outside the intended purpose, to the extent permitted by applicable law.
15. Intellectual Property
All content of the online store, including text, graphics, photographs, logos, product descriptions and other materials, is protected by applicable intellectual property laws unless otherwise indicated.
No content may be reproduced, distributed, modified or commercially used without prior authorization, except where permitted by law.
16. Limitation of Liability
To the extent permitted by applicable Swiss law, bike-p-arts shall not be liable for indirect or consequential damages arising from the use or inability to use a product.
This includes, where legally permissible, loss of profit, loss of business, loss of data or other indirect economic losses.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory Swiss law, including liability that cannot legally be excluded or limited.
In particular, nothing in these Terms is intended to exclude liability for personal injury, death, intentional misconduct or gross negligence where such liability cannot legally be excluded.
17. Force Majeure
We shall not be responsible for delays or failures caused by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, war, government measures, strikes, significant transport disruptions, customs delays, supplier failures, pandemics or interruptions to infrastructure or logistics services.
18. Privacy
Personal data is processed in accordance with our Privacy Policy.
By placing an order, the customer acknowledges that order and delivery information may need to be shared with payment providers, logistics providers, suppliers or other service providers involved in fulfilling the order, where necessary for processing and fulfilling the order and as permitted by applicable data protection law.
19. Changes to These Terms
We reserve the right to update these Terms from time to time.
The version applicable to an order is the version in force at the time the order is placed, unless mandatory law requires otherwise.
20. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid or unenforceable provision shall be replaced or interpreted, to the extent legally permissible, in a manner that most closely reflects its intended purpose.
21. Applicable Law and Jurisdiction
These Terms are governed by Swiss law, subject to any mandatory statutory provisions applicable to consumers.
Where legally permissible, the courts at the registered address of bike-p-arts shall have jurisdiction over disputes arising from or relating to these Terms.
Mandatory consumer protection provisions that cannot legally be excluded remain unaffected.
